Kiki Terms of Service

Effective October 4, 2026

1. Acceptance

These Terms are between you and Emma Paunil-Mattison, doing business as "Ask Kiki," a sole proprietorship based in Arizona, United States ("Kiki," "we," "us"). By creating a Kiki account — including by completing registration or confirming any acceptance step presented during signup — or by otherwise using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't create an account or use Kiki.

2. The service

Kiki provides AI-generated style, beauty, hair, and wardrobe guidance and illustrated "Looks" based on photos and information you provide. Kiki is not a medical, dermatological, or healthcare provider, and nothing in the app is medical advice or a treatment plan. Illustrated Looks are art, not a guarantee of any real-world result.

3. Accounts

One account per person. You're responsible for keeping your login secure and for activity on your account. Kiki is intended only for people 18 or older, and by creating an account you represent that you are at least 18. We check the birthdate you provide at signup and will not let an account be created if it indicates you're under 18. If we otherwise learn that an account belongs to someone under 18 — for example, an account created through a method that doesn't run that check — we will review the account promptly and take steps to close it and delete the associated data, consistent with our Privacy Policy.

4. Subscriptions & billing

  • Kiki Free: no cost.
  • Kiki Core and Kiki VIP: paid subscriptions billed monthly or annually, processed by Wix Payments, at the pricing shown at askkiki.io/pricing.
  • New accounts receive full Core-tier access for 30 days or until their first Challenge is marked complete within the app, whichever happens first, at no charge. When that period ends, your account switches to Kiki Free unless you have purchased a paid subscription — the trial does not automatically convert into a paid subscription or charge you.
  • Paid subscriptions renew automatically until cancelled. You can turn off auto-renewal anytime in Settings; doing so stops future charges but does not end your current access early — you keep full access through the end of the period you already paid for, then the account moves to Kiki Free. Deleting your account entirely is different and ends access immediately — see our Privacy Policy, Section 8.
  • Payments are non-refundable, except where required by law. This applies to initial purchases, renewal charges, and annual subscriptions alike; we do not refund for the unused portion of a billing period if you cancel partway through. If you believe you were charged in error — for example, a duplicate charge for the same period — contact hello@askkiki.io and we will review and correct confirmed billing errors.
  • Price, renewal, and cancellation terms are shown at checkout before you pay, in addition to being stated here.

5. Content you provide

You retain whatever rights you hold in the photos and other content you upload — we are not asserting that you necessarily hold full copyright in every photo you upload (for example, a photo someone else took of you), only that we are not taking anything from you beyond what's described here.

You grant Kiki a license to use what you upload to provide the service to you — generating your Looks, Digital Closet, and progress tracking — and to operate the service through the infrastructure and processing described in our Privacy Policy, Section 5. That includes the processing our hosting/infrastructure provider performs in the course of running our app, as disclosed there. Kiki itself does not use your content for its own marketing or to train any model Kiki develops or controls, without your separate, explicit opt-in — but, as Privacy Policy Section 5 explains, our infrastructure provider's own data-use terms are broader than that promise, and this license is granted with that disclosed reality in mind, not in spite of it.

6. AI-generated content ("Looks")

Kiki grants you permission to use, save, and share the Looks generated for your account for personal and social purposes — viewing them, saving them, and sharing them on social media or with others. This permission does not include commercial use (for example, selling prints, merchandise, or using a Look in monetized content) without Kiki's separate written permission.

This section is about what you can do with your own Looks — it does not give Kiki any right to post, share, or publicly display your individual Looks. If we ever offer a feature to feature your Look publicly (for example, on a community page), that will require your separate, explicit opt-in, which you can decline without losing access to the Service.

This is a permission Kiki grants you, not a guarantee or transfer of copyright. The copyright status of purely AI-generated images is unsettled under current U.S. law — the Copyright Office's position turns on whether there is sufficient human authorship involved, not simply whether AI was used — so we are not promising you own an enforceable copyright in a Look, and we are not claiming one for ourselves either. Any rights belonging to a third party depicted in or connected to your own uploaded photo remain that person's, regardless of this permission.

7. Acceptable use

No sharing accounts. No uploading photos of anyone but yourself without their consent. No using Kiki for unlawful purposes, to harass or impersonate others, to attempt to access another user's data or account, or to interfere with or disrupt the Service (including by scraping it or attempting to bypass its security or rate limits).

8. Suspension & termination

We may suspend or terminate your access to Kiki if we reasonably believe you've violated these Terms (including the Acceptable Use section above), if required by law, or to protect the security or integrity of the Service. Where practical, we'll tell you why. You can stop using Kiki and delete your account at any time, as described in our Privacy Policy, Section 8. The sections of these Terms that by their nature should continue to apply after your account is closed — including AI-generated content (Section 6), disclaimers and limitation of liability (Section 12), and governing law (Section 15) — remain in effect.

9. Kiki's intellectual property

Other than the content you provide and the Looks generated for your account, Kiki and its licensors own the Service itself, including its software, design, text, graphics, and the Kiki name and logo. These Terms don't give you any right to use Kiki's branding, trademarks, or underlying software beyond what's needed to use the Service as intended.

10. Third-party services

Kiki relies on third-party providers to operate — currently including Base44 (our application and hosting platform), the AI models invoked through it, and Wix Payments (our payment processor), as described in our Privacy Policy. We don't control these providers' own services and aren't responsible for their outages, errors, or changes, though we'll work to address issues that affect you. If Kiki ever links to or integrates with other third-party products or services, your use of those is governed by their own terms, not ours.

11. Changes to the service

Kiki is an actively developing product, and we may add, change, or remove features, pricing, or plans over time. If we make a change that meaningfully reduces what's included in a paid plan you're subscribed to, we'll give you reasonable notice, consistent with the billing terms in Section 4.

12. Disclaimers & limitation of liability

THE SERVICE — INCLUDING ANY STYLING RECOMMENDATIONS, AI-GENERATED CONTENT, AND ILLUSTRATED LOOKS — IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T GUARANTEE THAT KIKI'S RECOMMENDATIONS OR GENERATED CONTENT WILL MEET YOUR EXPECTATIONS, BE ACCURATE, OR BE UNINTERRUPTED OR ERROR-FREE. AS STATED IN SECTION 2, KIKI IS NOT A MEDICAL, DERMATOLOGICAL, OR HEALTHCARE PROVIDER, AND NOTHING IN THE SERVICE IS MEDICAL ADVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIKI, EMMA PAUNIL-MATTISON, AND OUR SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100).

NOTHING IN THIS SECTION LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. SOME STATES DON'T ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Service area

Kiki is currently offered only to users located in the United States. We may expand to other countries in the future; this section will be updated before that happens.

14. Governing law & disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of Kiki will be brought in the state or federal courts located in Arizona, and you consent to that venue. These Terms do not include a mandatory arbitration clause or class-action waiver — that's a deliberate choice, not an omission, and nothing here limits any right you have under your home state's consumer-protection laws that can't be waived by contract.

15. Changes to these terms

We may update these Terms as Kiki changes. If we make a material change — one that meaningfully affects your rights, your billing, or our liability to you — we'll notify you by email or in-app notice at least 14 days before it takes effect. Continuing to use Kiki after that point means you accept the updated Terms; if you don't agree, you can delete your account before the change takes effect, as described in our Privacy Policy, Section 8. Non-material changes (like clarifications or typo fixes) may take effect immediately upon posting.
